4.1 When you place an order, you are making an offer to purchase the listed products. We reserve the right to accept or refuse any order at our discretion.
 4.2 All orders are subject to availability and confirmation of price.
 4.3 Prices are displayed in U.S. Dollars (USD) unless otherwise stated and include/exclude applicable taxes as shown at checkout.
 4.4 Payment must be made using one of the accepted methods shown at checkout. You confirm that the payment method is yours or that you are authorized to use it.
 4.5 We make reasonable efforts to ensure pricing and product information are accurate, but errors may occur. If a pricing error is identified after you place an order, we will contact you to confirm whether you wish to proceed at the correct price or cancel.

 

 

5. Shipping & Delivery

5.1 Orders are shipped to the address provided at checkout.
 5.2 Delivery times shown on the Site are estimates only and may vary.
 5.3 Risk of loss passes to you once we hand the goods to the carrier.
 5.4 We are not liable for delays caused by customs clearance or circumstances beyond our control.

7. Returns, Exchanges & Refunds

7.1 Standard Returns

  • Returns or exchanges are accepted within 14 days of delivery.

  • Items must be unworn, unwashed, with original tags attached, and returned in original packaging.

Legal compliance:
 • In the European Union (EU/EEA), consumers have a minimum 14-calendar-day right of withdrawal under the EU Consumer Rights Directive 2011/83/EU.
 • In the United States, there is no federal return-right law, but retailers must honor their stated policy.

Therefore, Cape God’s 14-day return window is valid and compliant in both jurisdictions.

7.2 Made-to-Order or Custom Items

For the avoidance of doubt, made-to-order, customized, or rush-delivery items (including custom colors or sizing) are non-returnable and non-exchangeable, unless defective.

7.3 Damaged or Worn Returns

Items returned in a worn, damaged, or used condition will not be accepted. They may be returned to the sender at their expense or disposed of at our discretion.

7.4 Refunds

  • Approved refunds cover the cost of the item only; original shipping fees are non-refundable.

  • Refunds are issued to the original payment method within 5–10 business days after inspection and approval.

  • Customers are responsible for return shipping costs unless otherwise agreed.

7.5 EU Customers – Right of Withdrawal

If you are an EU consumer, you may exercise your statutory 14-day right of withdrawal from the date of delivery for standard goods. This right does not apply to personalized or made-to-order items.

These Terms are governed by and construed in accordance with the laws of the State of New York, USA, unless otherwise required by mandatory consumer-protection law in your jurisdiction.
 You agree to submit to the non-exclusive jurisdiction of the courts located in New York, NY.
